ホテルや旅館のように施設を設け、宿泊料を受けて人を宿泊させる営業を行うためには「旅館業」の許可が必要になります。

無許可営業は、営業停止はもちろん懲役刑や罰金刑といった重い処罰の対象になります。

 

　旅館業の種類

　　①ホテル営業　　…洋風構造、設備

　　②旅館営業　　　…和風構造、設備

　　③簡易宿所営業　…宿泊する場所を多数人で共用する構造、設備

　　　　　　　　　　　（ゲストハウス、ペンション、カプセルホテル、貸別荘など）

　　④下宿営業　　　…1月以上の期間を単位として宿泊させる営業

 

上の4種類のような営業をする場合、「旅館業法」を根拠とした許可を得なくては営業をすることはできません。営業を始めた後も様々な義務が発生します。

 

また、設置する設備や環境によっては

・建築基準法

・消防法

・水質汚濁防止法

・公衆浴場法

・食費衛生法

・風営法　　などなど様々な法令が関わります。そのため計画段階においての事前調査など十分な検討がとても重要です。
